* While walking through the clothing department of Wal Mart, Kelly tripped on a garment rack that was in the aisle, fell to the floor and struck her head. Due to severe facial bruising and swelling, she temporarily lost the use of her left eye. She was transported to Monongala General Hospital where she received stitches. Kelly is seeking special damages, past and future medical costs, attorney fees and damages for pain and suffering.

* Franklin May sustained injuries while walking on Cipolloni's property located on the corner of Willowdale and Valley View Road. May alleges he fell into a large unmarked hole that was hidden by high grass, injuring his back and knee. He is seeking compensation for damages, pain and suffering, past and future medical expenses and lost compensation from work.
