CHARLESTON -- A man is suing Apollo Oil and two if its employees for discrimination.

Gary Stewart was employed at Apollo Oil from July 1, 2001, until May 29, 2009, according to a complaint filed Oct. 16 in Kanawha Circuit Court.

Stewart claims he was discharged from Apollo Oil because of his age and that Apollo Oil is in violation of the West Virginia Human Rights Act.

Dale Hardwick was Stewart's supervisor and Phil Holley was the president of Apollo Oil, and were both in violation of West Virginia code, according to the suit.

Stewart claims he is entitled to back pay and award for emotional distress, embarrassment and mental anguish. He is suing for this back pay; compensatory damages for embarrassment, emotional distress and mental anguish; and punitive damages for the intentional and willful violation of the State Public Policy.
