WINFIELD -- City National Bank is suing a Putnam County woman after it mistakenly transferred $50,000 into her savings account.
Teresa E. Sperandio opened a savings account with City National Bank in 1996 and on June 18, 2008, the bank accidentally credited the savings account with $50,000, according to a complaint filed Nov. 5 in Putnam Circuit Court.
Between Nov. 10, 2008 and Feb. 23, 2009, Sperandio had withdrawn a total of $48,000, according to the suit.
On March 17, 2009, City National Bank discovered its error and debited the $50,000 from Sperandio's account, which resulted in her account having a negative balance of -- $31,194.21.
City National Bank claims Sperandio knew she was not entitled and had no authority to withdraw and receive $48,000 from the savings account and because of this, the bank suffered $31,194.21 in damages.
The bank is suing for damages in the amount of $31,194.21, plus interest for Breach of written account agreement, breach of implied agreement, unjust enrichment, negligent misrepresentation, breach of duty of good faith and fair dealing. The bank is being represented by James W. Lane Jr. and William F. Kirk.
