Woman sues three individuals for the death of her son

HUNTINGTON -- A woman is suing three individuals for the 2007 death of her son.

On Nov. 26, 2007, Michael Shane Sharp was shot and killed by Carson Jeffers, who is now a convicted felon and inmate in the West Virginia State prison system, according to a complaint filed Nov. 24 in Cabell Circuit Court.

Malana Sharp was named Administratrix of Michael Shane Sharp's Estate.

At the time of the incident, Delbert L. and Laura Fulks owned and operated the four-unit apartment building in Huntington where Jeffers lived.

According to the suit, Jeffers negligently, carelessly, willfully and wantonly shot and killed Michael Shane Sharp, who was a visitor at the apartment building at the time and visiting his girlfriend.

Malana Sharp claims the Fulkses failed to property investigate Jeffers' prior criminal and mental history and failed to act when they were informed and otherwise knew or should have known that Jeffers posed a threat to the safety and welfare of the tenants and their guests at the apartment building.

Malana Sharp is seeking compensatory and punitive damages for Michael Shane Sharp's wrongful death. Roger Lambert is representing her.

The case has been assigned to Circuit Judge F. Jane Hustead.
