HUNTINGTON -- A former employee is suing Marshall University after she claims she was fired for refusing to work in unsafe work conditions.
Cecilia R. Scarberry was employed at Marshall University until August 2007, according to a complaint filed Dec. 1 in Cabell Circuit Court.
Scarberry claims she refused to perform work which exposed her and her co-workers to risks of injury or death.
According to the suit, Scarberry made several attempts to address concerns regarding failure to provide safe equipment and working conditions.
Scarberry claims the defendant is also responsible for defamatory allegations made against her, including claims that she physically assaulted a managerial employee.
Scarberry is seeking all administrative remedies available. She is being represented by Walt Auvil of Rusen & Auvil.
The case has been assigned to Circuit Judge F. Jane Hustead.
