Kentucky couple names 53 companies in asbestos case

CHARLESTON -- An Ashland, Ky., couple named multiple companies in their asbestos-related lawsuit.

Charles Ronald Miller and Nola A. Miller named 53 companies involved in their suit, according to a complaint filed Jan. 14 in Kanawha Circuit Court.

Mr. Miller claims he was exposed to asbestos products of the defendants while working at various job sites over many years.

On Sept. 18, 2009, Mr. Miller was diagnosed with lung cancer. He claims he smoked one and one-half packs of cigarettes per day from the late 1960s until 1991.

According to the suit, the defendants are being sued for negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn.

The Millers are seeking a trial by jury to resolve all issues concerning their asbestos-related case. They are being represented by Cindy J. Kiblinger of James F. Humphreys & Associates, and Victoria Antion of Motley Rice.

The case has been assigned to a visiting judge.
