Man sues after accident at Wal-Mart

CHARLESTON -- A Kanawha County man is suing Wal-Mart Stores East, LP; Wal-Mart Stores East, Inc.; and Wal-Mart Store #2576 after he claims he was injured at the store.

On March 21, 2008, Clyde Nelson was a customer at the Wal-Mart store in Cross Lanes when he tripped on a metal stake that was not properly market by any flags or cones, and was injured, according to a complaint file March 29 in Kanawha Circuit Court.

Nelson claims the defendants failed to use ordinary and reasonable care in maintaining the premises in the immediate area of the shopping areas where he fell.

The defendants, through its employees and/or agents were aware of the location of the metal stake and the potential danger its location could pose to customers, according to the suit.

Nelson claims he suffered bodily injuries that required medical care and treatment.

Nelson is seeking compensatory damages for his injuries. He is being represented by Harry F. Bell Jr. of the Bell Law Firm.

The case has been assigned to Circuit Judge Louis Bloom.
