WINFIELD —- A Gallia County, Ohio, man is suing Home Run Inc. and one of its employees after he was injured in an accident in Hurricane.

On May 15, 2008, James A. Mullins was operating his vehicle and traveling southbound on U.S. 35 near the intersection of Hurricane Creek Road and was slowing down because a vehicle in front of him was turning, according to a complaint filed April 16 in Putnam Circuit Court.

Steven M. Koebel, also from Gallia County, was operating a vehicle owned by Home Run, which is based in Ohio, and failed to stop and collided with Mullins' vehicle, according to the suit.

Mullins claims Koebel had a duty to operate his vehicle in a reasonably prudent manner and failed to do so.

As a result of Koebel's negligence, Mullins endured physical and emotional pain and suffering; annoyance and inconvenience; loss of his capacity to enjoy life; and has incurred medical bills, according to the suit.

Mullins is seeking compensatory damages. He is being represented by Michael J. Del Giudice.

The case has been assigned to Circuit Judge O.C. Spaulding.
