HUNTINGTON -- A Cabell County woman and her husband are suing C.R. Bard and a Huntington surgeon for defective medical devices that were implanted into her during surgery.
On Nov. 26, 2007, Dr. Mitchell E. Nutt performed surgery on Betty Adkins at St. Mary's Medical Center, according to a complaint filed June 3 in Cabell Circuit Court.
During the surgery, Nutt implanted an Avaulta Plus Anterior and Posterior BioSynthetic Support System into Adkins to treat her pelvic organ prolapse, according to the suit.
Adkins claims the medical devices implanted into her were designed, manufactured, marketed, packaged, labeled and sold by C.R. Bard.
As a result of having the medical devices implanted into her, Adkins has experienced significant mental and physical pain and suffering; has sustained permanent injury; permanent and substantial physical deformity; and loss of a bodily organ, according to the suit.
Adkins claims the defendants were negligent in failing to use reasonable care in designing, manufacturing, marketing, labeling, packaging and selling the products.
Adkins and her husband, Raymond Adkins, are seeking compensatory and punitive damages. They are being represented by Paul T. Farrell Jr., Lawrence J. Tweel, J. Robert Rogers, Gary B. Blasingame and Henry G. Garrard III.
The case has been assigned to Circuit Judge David M. Pancake.
