CHARLESTON -- A former employee is suing Sbarro after he claims it violated the West Virginia Wage Payment & Collection Act.

John Chapman worked for Sbarro until his discharge on May 20, according to a complaint filed July 7 in Kanawha Circuit Court.

Chapman claims the defendant failed to pay him his wages within 72 hours of his discharge, which is in violation of the West Virgina Wage Payment & Collection Act.

Chapman is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess.

The case has been assigned to Circuit Judge Jennifer Bailey.
