Couple sues City of Marmet for water drainage problems

CHARLESTON -- A couple is suing the City of Marmet after they claim it negligently caused asphalt to be put on Maryland Avenue in such a manner that a rain water drain that drains water from their residence cannot freely flow.

In August 2009, William J. Reese and JoAnn T. Reese's property suffered water damage, according to a complaint filed July 29 in Kanawha Circuit Court.

The Reeses claim the defendant's employees and/or agents and/or contractors negligently caused asphalt to be put onto Maryland Avenue in such a manner that rain water draining off of their neighbor's property drained directly onto their property.

The couple is seeking for the drainage system to be corrected and compensatory damages. They are being represented by G. Patrick Jacobs.

The case has been assigned to Circuit Judge Tod J. Kaufman.
