Ohio couple files medical malpractice suit

HUNTINGTON -- A Proctorville, Ohio, couple is suing University Physicians & Surgeons and a Huntington physician for medical malpractice.

On May 5, 2008, Sara Tschop presented to Dr. Linda Savory and UP&S, complaining of pain in her left side and back and nausea that had lasted four days, according to a complaint filed Aug. 11 in Cabell Circuit Court.

The defendants ordered a CT scan, which revealed bilateral non-obstructing renal calculi and mild left hydronephrosis, secondary to a 0.9 cm left UPC calculus, according to the suit.

Tschop claims the defendants were aware of the CT scan results no later than May 6. She claims she was seen for her follow-up appointments on May 20 and June 18, 2008, and was prescribed narcotic pain medication for treatment of the renal stone and referred to an endocrinologist for evaluation of the chemical composition of the stone.

On Aug. 15, 2008, Tschop consulted with Dr. Bodo Knudsen, a urologist, and discovered she had a 10 mm left renal calculus. On Aug. 20, 2008, Knudsen performed a cystoscopy left retrograde pyelogram, left ureteroscopy with laser lithotripsy and left double-J stent insertion for treatment of the stone, according to the suit.

On March 10, 2009, a renal scan revealed approximately 6.6 percent function of Tschop's left kidney, according to the suit, and on May 18, Dr. James Jensen performed a robotic laparoscopic left nephrectomy on Tschop due to her non-functioning left kidney.

Tschop claims the defendants failed to exercise reasonable care in their treatment for her by failing to appropriately monitor the left urethral stone and failing to timely refer her to a urologist or nephrologist.

Tschop and her husband, Kenneth L. Tschop Jr., are seeking compensatory damages with pre- and post-judgment interest. They are being represented by William L. Mundy and Debra A. Nelson.

The case has been assigned to Circuit Judge F. Jane Hustead.
