Elkview woman sues Smith's Foodfair for injuries

CHARLESTON -- An Elkview woman is suing Smith's Foodfair after she claims she and her unborn child were injured on its premises.

O.V. Smith & Sons is doing business as Smith's Foodfair #3, according to the complaint.

On June 15, Tiffany Hively was checking out at Smith's Foodfair when she fell on the wet floor, according to a complaint filed Oct. 21 in Kanawha Circuit Court.

Hively claims she sustained injuries to her leg and hip, and her unborn child sustained injuries because of the fall.

The defendant was negligent in failing to keep the floors free from slippery substances, according to the suit.

Hively claims the defendant failed to mop up the dangerous substances on the floor that caused her to fall.

Hively is seeking compensatory damages. She is being represented by Michelle L. Johnson.

The case has been assigned to Circuit Judge Carrie Webster.
