Adams Hallmark sues Charleston Town Center for waste water damages

CHARLESTON -- Adams Hallmark is suing the Charleston Town Center for waste water damages to its stockroom.

R Z Investments, Elco Mechanical Contractors and Pray Construction Company also were named as defendants in the suit.

On Dec. 1, 2008, waste water periodically leaked from a drain line into Adams Hallmark's stockroom, according to a complaint filed Nov. 22 in Kanawha Circuit Court.

The plaintiff claims Elco was retained to fix the problem by the Charleston Town Center. But after inspecting the problem, the Elco employee was not able to retrieve the part to fix the sewer line until the following day, and as an alternative, adhered packaging tape to the line as a temporary fix

Later that day, the leaking pipe burst and spilled waste water into the plaintiff's stockroom, according to the suit.

Adams Hallmark claims the pipe that burst was a waste water pipe that runs to R Z Investments' store, which is directly above the Hallmark store.

Several months prior, Pray Construction was hired to reconfigure the plumbing for R Z Investments when it was moving into the mall facility, according to the suit.

The plaintiff is seeking compensatory damages with pre- and post-judgment interest. It is being represented by Regis J. Moeller and Scott Andrews.

The case has been assigned to Circuit Judge Charles King.
