CHARLESTON -- A Kanawha County woman is suing Taco Bell and Yum! Brands after she claims she bit into a rock in her food.

On Dec. 9, 2008, Lora L. Rutledge purchased food from Taco Bell in Charleston and was leaving the store while consuming the food when she bit down on a rock or stone hidden in the food, according to a complaint filed Dec. 9 in Kanawha Circuit Court.

Rutledge claims the defendants knew or should have known of the "unsafe and dangerous condition that would have been caused by failing to warn the consumer/customers of the hazardous condition or foreign object."

The defendants had a duty to take responsible precautions to prevent injuries to its customers, according to the suit.

Rutledge claims she sustained injuries, including a cracked or broken tooth; an extracted tooth; abrasions and contusions of the mouth; and mental and physical pain and suffering and distress.

Rutledge is seeking compensatory damages. She is being represented by Michael V. Marlow.

The case has been assigned to Circuit Judge James C. Stucky.
