Man sues Charleston Town Center for injuries

CHARLESTON -- A Kanawha County man is suing the Charleston Town Center after he claims he was injured in a fall.

In Town Shopping Center, Inc.; Firest City Enterprises, Inc.; and Forest City Commercial Management, Inc. were also named as defendants in the suit.

On Aug. 18, 2010, Ronald L. Gillenwater II was a customer at the Charleston Town Center and was walking on the second floor when he slipped and fell, according to a complaint filed Feb. 3 in Kanawha Circuit Court.

Gillenwater claims water had leaked from the roof and and carelessly been left on the floor.

The defendants owned a duty to maintain the facility in a reasonably safe condition and failed to do so, according to the suit.

Gillenwater claims the water was a hazard and the defendants failed to remove it from the floor.

Gillenwater is seeking compensatory damages. He is being represented by Shawn R. Romano.

The case has been assigned to Circuit Judge Louis Bloom.
