Marmet couple sues contractor, Miss Utility for home problems

CHARLESTON -- A Marmet couple is suing Mike Enyart & Sons and Miss Utility of West Virginia after it claims it caused problems to their home.

In March 2010, the defendants engaged in busting and removing the asphalt roadway on 87th Street in Marmet, near properties owned by Ruth and Sheldon Jacobs, according to a complaint filed Feb. 11 in Kanawha Circuit Court.

The couple claims soon after, they began to experience cracks and other problems to their home.

The defendants were negligent in construction, engineering and mapping methods in the removal of the asphalt, according to the suit.

The couple claims the defendants are responsible for the problems they have experienced.

The Jacobses are seeking compensatory damages with pre- and post-judgment interest. They are being represented by G. Patrick Jacobs.

The case has been assigned to Circuit Judge James C. Stucky.

Two families had also previously filed suits against the defendants for the same reasons.
