HUNTINGTON -- A woman is suing a Barboursville attorney after she claims the attorney violated the rules of professional conduct.
In January 2003, LaRita Evans sought legal counsel from Amy Herrenkohl pertaining to her then current family situation concerning erratic spousal behavior, the safety of her child and protective rights, according to a complaint filed March 31 in Cabell Circuit Court.
Evans claims Herrenkohl violated the rules of professional conduct as governed by the Office of Disciplinary Counsel of West Virginia by misrepresentation and incompetency.
Herrenkohl directly committed legal malpractice and caused a significant chain of misguided events from which Evans sustained serious personal injuries, according to the suit.
Evans claims Herrenkohl failed to provide a competent and skillful representation; showed incompetence by not possessing the necessary legal knowledge and skill required for the case; did not provide thoroughness and preparation which was reasonable and necessary for her contracted services; and did not act with reasonable diligence or promptness in representing her.
Evans is seeking compensatory damages. She is representing herself.
The case has been assigned to Circuit Judge F. Jane Hustead.
