CHARLESTON -- A Clendenin woman is suing West Virginia-American Water Company after she claims a land slide occurred because of a leak in a water line.
Diana Davey claims prior to July 14, 2010, a leak developed in a water line owned, operated and maintained by the West Virginia-American Water Company that runs across the front of the property co-owned by Davey and John Hizer, as well as the property of their neighbors, according to a complaint filed May 18 in Kanawha Circuit Court.
Davey claims a major slippage occurred at the back of the property on July 14, 2010, and the five structures on the property were damaged.
The defendant was negligent and breached its duties by failing to promptly and properly remedy any defects in the water line, according to the suit.
Davey is seeking compensatory damages with pre- and post-judgment interest. She is being represented by James C. Stucky.
The case has been assigned to Circuit Judge James C. Stucky.
