WINFIELD – A former employee is suing North American Industrial Services, Inc., after he claims it failed to pay him his full employment wages within 72 hours of his discharge.
From January 2005 until May 10, Gary W. Jones was employed by North American Industrial Services, according to a complaint filed June 21 in Putnam Circuit Court.
Jones claims when his employment was terminated, the defendant failed to pay him his employment wages and/or fringe benefits in full within 72 hours of discharge.
The defendant did not provide Jones with his final employment wages and/or fringe benefits until May 20, according to the suit.
Jones claims the defendant violated the West Virginia Wage Payment and Collection Act by failing to pay him in full within 72 hours of discharge.
North American Industrial Services, Inc. caused Jones indignity, embarrassment, humiliation and emotional distress, according to the suit.
Jones is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge Phillip Stowers.
