WINFIELD – A Putnam County woman is suing Genesis Healthcare Corporation after she claims they are responsible for the death of a nursing home resident.
Teays Valley Center was also named as a defendant in the suit.
On four separate occasions in 2009 and 2010, Anoway Rose Smith was a resident of the defendants' nursing home, according to a complaint filed June 23 in Putnam Circuit Court.
Bonita Tomblin claims the defendants failed to care for Smith in accordance with their resident care plan.
The defendants also failed to provide Smith with proper nutrition and failed to prevent skin breakdown from developing, according to the suit.
Tomblin claims the defendants failed to care for Smith in a manner in such an environment free of accident hazards so as to promote the maintenance or enhancement of her quality of life.
The defendants' acts and omissions violated Smith's right to be treated courteously, fairly and with the fullest measure of dignity and directly caused Smith's wrongful death, according to the suit.
Tomblin is seeking compensatory and punitive damages. She is being represented by Andrew L. Paternostro and Jeff D. Stewart of The Bell Law Firm in Charleston.
The case has been assigned to Circuit Judge Phillip Stowers.
