Couple says GM, C&O sold them defective vehicle

CHARLESTON -- General Motors and C&O Motors are being sued after a couple claims a vehicle they purchased was defective.

On June 13, 2009, John O'Neal and Christa O'Neal entered into a motor vehicle purchase contract with the defendants for the purchase of a 2008 Chevrolet Impala, according to a complaint filed June 30 in Kanawha Circuit Court.

The O'Neals claim they were told the vehicle was new and had no history of prior problems or damage, when in fact the vehicle was used, damaged or defective.

After purchasing the vehicle, the O'Neals discovered non-conformities that substantially impaired the use, value and/or safety of the vehicle and returned the vehicle to the defendants for repair, according to the suit.

The O'Neals claim the defendants failed and refused to provide a comparable replacement vehicle and failed to reimburse them.

The O'Neals are seeking for the contract involved to be canceled by rejection, rescission or revocation of acceptance; and compensatory and punitive damages. They are being represented by Cameron S. McKinney.

The case has been assigned to Circuit Judge Jennifer Bailey.
