Cabell sheriff, deputy sued for excessive force

HUNTINGTON -- A man is suing Cabell County Sheriff Thomas McComas and Cabell County Deputy Sheriff Greg Perry after he claims excessive force was used on him.

On Dec. 20, 2010, Perry engaged in objectively unreasonable conduct that negatively impacted a protected right of the plaintiff, Jason Douglas Freeman, while he was being held in jail and awaiting a court hearing, according to a complaint filed July 26 in Cabell Circuit Court.

Freeman claims Perry choked and assaulted him on three separate occasions, tried pushing his face into a toilet and put him in a headlock.

As a result, Freeman was thrown against the wall, hitting his head and causing a knot on the back of his head; had bruises on his throat from being choked; and his neck was hurt from being put into a headlock, according to the suit.

Freeman is seeking judgment in the amount of $20,000. He is representing himself.

The case has been assigned to Circuit Judge David M. Pancake.
