CHARLESTON -- A Charleston man is suing 73 companies he claims are responsible for a family member's lung cancer and death.

On Aug. 6, 2009, Norvell Vaughn Dye was diagnosed with lung cancer, of which he died on Aug. 13, 2009, according to a complaint filed July 29 in Kanawha Circuit Court.

Paul Feazell claims the 73 defendants are responsible for Dye's lung cancer and death and for exposing him to asbestos and/or asbestos containing materials.

The defendants are being sued based upon theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

Feazell is seeking a jury trial to resolve all issues involved. He is being represented by Victoria Antion and Bronwyn I. Rinehart.

The case has been assigned to a visiting judge.
