Visitor sues St. Mary's Medical Center for injuries

HUNTINGTON -- A Barboursville woman is suing St. Mary's Medical Center after she was injured while visiting another patient.

On Sept. 11, 2009, Nicole Enix was at the hospital to see another patient when she slipped in a wet substance near the hospital exit and was injured, according to a complaint filed Sept. 1 in Cabell Circuit Court.

Enix claims the defendant had a duty of care to keep the premises in a reasonably safe condition and failed to do so.

The defendant also failed to properly provide and maintain adequate lighting, according to the suit.

Enix claims in failing to keep the passageway intended for public use free and clear from unreasonable defects, hazards or obstructions.

The defendant was also negligent in failing to warn Enix of the existence of the dangerous conditions, according to the suit.

Enix is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Paul E. Biser.

The case has been assigned to Circuit Judge David M. Pancake.
