CHARLESTON -- A former employee is suing One Communications Management Co. and Fibernet for failure to pay her final wages within 72 hours of discharge.
Connie Davis was employed by the defendants as a salesperson until her discharge on May 8, 2009, according to a complaint filed Sept. 9 in Kanawha Circuit Court.
Davis claims the defendants failed to pay her final wages, including fringe benefits, within 72 hours of her discharge.
The defendants' actions violated the West Virginia Wage Payment and Collection Act, according to the suit.
Davis is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge Carrie Webster.
