Ranch dressing results in slip-and-fall suit against Cold Spot

CHARLESTON – A Kanawha County couple are suing The Cold Spot for injuries sustained in its restaurant.

On Feb. 2, 2010, Rita Brock was walking from the defendant's store to its restaurant when she slipped on ranch dressing that had been spilled on the floor and fell, according to a complaint filed Oct. 7 in Kanawha Circuit Court.

Brock claims she sustained severe and permanent mental and physical injuries from the fall.

The defendant had a duty to responsibly maintain its premises free and clear from any and all unsafe conditions so as not to expose Brock to unsafe conditions, according to the suit.

Brock claims as a result of the defendant's negligence and failure to maintain its premises, she incurred damages.

Brock's husband, Curtis Brock, incurred a loss of consortium for which the defendant is liable, according to the suit.

The Brocks are seeking compensatory damages. They are being represented by Michael J. Del Giudice.

The case has been assigned to Circuit Judge Charles E. King.
