Man says he slipped on snow, ice at Wal-mart

CHARLESTON -- A man is suing Wal-mart after he slipped on ice and snow and was injured on its premises.

On Feb. 12, 2010, Kevin McKenzie was at Wal-mart in Kanawha County when he slipped and fell because of ice and snow on the parking lot, according to a complaint filed Feb. 10 in Kanawha Circuit Court.

McKenzie claims the defendant negligently, carelessly and wrongfully permitted snow and ice to be present in the parking lot and in his path, which caused his injuries.

The defendant had a duty to maintain the parking lot in a safe way and failed to do so, according to the suit.

McKenzie is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Trent A. Redman and Michael D. Payne.

The case has been assigned to Circuit Judge James C. Stucky.
