CHARLESTON -- A Clendenin woman is suing Speedway for injuries she sustained on its premises.
Crystal Gooch, an employee of Speedway, was also named as a defendant in the suit.
On July 7, 2010, Sabrina Payne purchased a 5-pound bag of ice from the defendants' Elkview location when she tripped and fell in the parking lot and was injured, according to a complaint filed March 7 in Kanawha Circuit Court.
Payne claims she sought treatment at Urgent Care for injuries to her left elbow, left knee, jaw, left shoulder and left foot.
A few days after the fall, Payne became concerned about the ongoing pain in her left foot and went to Urgent Care again, where x-rays revealed her foot was not broken, but was jammed in a way that made it difficult for her to walk, according to the suit.
Payne is seeking compensatory damages. She is being represented by Rudolph L. DiTrapano, Robert M. Bastress and Elizabeth G. Kavitz.
The case has been assigned to Circuit Judge Charles E. King.
