Louisville woman names 60 defendants in late husband's asbestos case

CHARLESTON -- A Louisville, Ky., woman is suing 60 companies she claims are responsible for her husband's lung cancer and death.

On Dec. 20, 2009, Rudolph Woodson Moore was diagnosed with lung cancer, from which he died on March 31, 2010, according to a complaint filed March 29 in Kanawha Circuit Court.

Evelyn Moore claims her husband had smoked cigarettes from 1970 until 2005, but then quit.

Rudolph Moore was exposed to asbestos and/or asbestos-containing products during his employment as a carman, painter, laborer and carpenter from 1943 until 1968, according to the suit.

Evelyn Moore claims the defendants failed to inform her husband of the dangers of asbestos exposure.

The defendants are being sued based on theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentation and post-sale duty to warn, according to the suit.

Evelyn Moore is seeking a jury trial to resolve all issues involved. She is being represented by Victoria L. Antion, Scott A. McGee and Bronwyn I. Rinehart.

The case has been assigned to a visiting judge.
