Couple, sister sue Silver City for assault, battery

HUNTINGTON -- A woman, her husband and his sister are suing Silver City for assault and battery that occurred at after a wedding reception.

MSG Properties, LLC is doing business as Silver City.

Catherine Green, a manager and member of MSG Properties, was also named as a defendant in the suit.

On June 12, 2010, Nicholas A. Nutini and Sarah-Brooke Nutini were married, and the reception was held at the Frederick Building. Following the reception, the celebration continued at the Silver City club, according to a complaint filed April 9 in Cabell Circuit Court.

The Nutinis and Nicholas Nutini's sister, Michele R. Nutini, claim at closing time, a Silver City staff member approached Sarah-Brook Nutini, while still in her wedding dress on the dance floor and yelled "Get the (expletive) out, you stupid tanned bitch," and an argument ensued between the staff member and the wedding party.

The Silver City staff attempted to forcibly remove the wedding party from the premises and members of the staff assaulted Sarah-Brooke Nutini and forcibly removed her from the premises by throwing her into the street, according to the suit.

The plaintiffs claim Silver City staff also assaulted Michele Nutini by striking her about her body and face, causing a severe head laceration.

A Silver City staff approached Nicholas Nutini from behind and placed him in a choke hold and proclaimed "go to sleep," and after he was on the floor, multiple staff members repeatedly struck him while the wedding party "watched in horror from outside the locked doors," according to the suit.

The plaintiffs claim the defendants negligently and/or intentionally assaulted them and caused them serious personal injuries and damages.

On June 15, 2010, two Silver City staff members were charged with felony malicious wounding and charges are still pending, according to the suit.

The plaintiffs are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Paul T. Farrell Jr.

The case has been assigned to Circuit Judge David M. Pancake.
