* After being discharged from WVU Hospitals for surgery to remove a brain tumor, Brittany McCrary became a patient at Health South Mountain View Rehab Hospital. She was under the care of Dr. Russell Biundo. The McCrarys allege Brittany suffered permanent physical injuries of bilateral visual defects, double vision and occasional blinks, incontinence, neurological defects and no movement of her extremities, which resulted in her death. The McCrary's claim the defendants were negligent in providing proper care, and are seeking compensatory and punitive damages, costs, attorney fees, pre and post judgment interest.
