Cabell couple sues St. Mary's Medical Center Foundation for injuries

HUNTINGTON -- A Cabell County couple is suing St. Mary's Medical Center Foundation, Inc. for injuries sustained on its premises.

On May 14, 2010, Connie Ann Nicely was lawfully on the defendant's premises when was caused to fall due to a slippery substance on the floor, according to a complaint filed April 30 in Cabell Circuit Court.

Nicely claims the defendant knew or should have known of the presence of the dangerous condition present on the floor of the cafeteria area and failed to warn her of the condition.

The defendant's negligence caused Nicely to lose her footing and fall onto the floor and injure her back, according to the suit.

Nicely claims the defendant caused her sustain severe and permanent injuries to her back, wrist, hip and leg.

The defendant's negligence also caused Nicely's husband, Ronald Nicely, to incur a loss of household services, society and consortium of his wife, according to the suit.

The Nicelys are seeking compensatory damages with pre-judgment interest. They are being represented by Matthew L. Clark.

The case has been assigned to Circuit Judge F. Jane Hustead.
