CHARLESTON -- A woman is suing Gabriel Brothers for injuries she sustained while on its premises.
On May 8, 2010, Peggy Wills entered the defendant's establishment to shop and was in the checkout aisle when she slipped on a liquid substance and was injured, according to a complaint filed May 2 in Kanawha Circuit Court.
Wills claims the defendant had a duty of care to keep its premises in a safe and appropriate manner and failed to do so.
The defendant's actions caused Wills to sustain injuries when she attempted to keep herself from falling, including strains to her hips, back and legs as she attempted to keep her balance, according to the suit.
Wills claims the defendant breached its duty it owed to her by allowing her to become injured.
As a result of the defendant's actions, Wills incurred medical bills in an estimated amount of $23,508.25, according to the suit.
Wills is seeking compensatory damages. She is being represented by Anthony M. Salvatore.
The case has been assigned to Circuit Judge Louis H. Bloom.
