Curry claims in August 2011 his treating physician gave notice to Jan-Care that Curry would be able to return to work on Sept. 20, 2011. The defendants did not inform Curry that it would not accommodate his disability and terminated his employment. Curry is seeking compensatory and punitive damages with pre- and post-judgment interest.

Carr is seeking civil penalties in the amount of $4,600 for each of the defendants' violations of West Virginia code and punitive damages.

Marcia Morgan died on July 28, 2010 after suffering gangrenous bowel and significant complications, which resulted in bilateral above-knee amputations and extreme pain and suffering.
