HUNTINGTON -- A Huntington man is suing Target after he claims he was injured at its Barboursville store.

On June 22, 2010, Henry E. Prout was at Target when he slipped on soda and fell to the floor, which caused him to sustain injuries to his left shoulder, according to a complaint filed May 25 in Cabell Circuit Court.
Prout claims the injuries he sustained due to the defendants' negligence required him to have surgery.
The defendants failed to properly design, engineer, construct, inspect, operate, clean, maintain and warn of the hazards of use at the defendants' premises at the time of the incident, according to the suit.
Prout claims he received extensive medical care for his injuries and suffered from a torn rotator cuff in his left shoulder, which resulted in scars and slight weakness still in his left arm.
The defendants' actions were negligent and reckless, according to the suit.
Prout is seeking compensatory and punitive damages with pre-judgment interest. He is being represented by J. Patrick L. Stephens and Mark F. Underwood.
The case has been assigned to Circuit Judge David M. Pancake.
