Man says he wasn't hired at Subway because of race

CHARLESTON -- A man is suing KJ Group, LLC after he claims the company did not hire him for a job at Subway because of his race.

Daniel E. Faucett is an African American male and was approached by Wade Shaffer, a manager who worked for KJ Group, and was informed by Shaffer that the defendant was looking to hire employees at its Subway on Goff Mountain Road, according to a complaint filed July 3 in Kanawha Circuit Court.

Faucett claims in April or May 2011 he went to the defendant's location and submitted a written application for employment.

After not hearing back from the defendant, Faucett contacted Shaffer to see if he knew what was occurring with the hiring process, according to the suit.

Faucett claims Shaffer informed him that he would not be employed because KJ Group "had made it known to its managers that said defendant would no longer be employing African Americans."

The defendant's failure to hire Faucett because of his race is a violation of the West Virginia Human Rights Act, according to the suit.

Faucett is seeking compensatory and punitive damages. He is being represented by J. Michael Ranson, Cynthia M. Ranson, George B. Morrone III and G. Patrick Jacobs.

The case has been assigned to Circuit Judge James C. Stucky.
