Man sues Corral Bar & Grill after assault

CHARLESTON -- A man is suing Corral Bar & Grill after he was attacked by patrons and/or employees when he was leaving the premises.

Russell B. Sears is doing business as Corral Bar & Grill, LLC.

On July 11, 2010, Chadwic Pauley was on the defendant's premises as a paying customer, according to a complaint filed July 6 in Kanawha Circuit Court.

Pauley claims upon attempting to leave the premises, he was attacked by patrons and/or employees of the defendant.

The defendant failed to provide bouncers or any other security to aid Pauley as he was being brutally attacked outside the door of the establishment by a patron and/or employee whom they had been serving alcohol for hours, according to the suit.

Pauley claims the beating continued by the intoxicated patrons and/or employees of the defendant as he was dragged onto Coonskin Drive, where he was repeatedly kicked and stomped until he lost consciousness.

The defendant owed a duty to Pauley to provide a safe environment both inside and outside of its premises and failed to do so, according to the suit.

Pauley claims as a result of the defendant's negligence, he received serious and permanent injuries and suffered great pain of body and mind.

The defendant's actions also caused Pauley to suffer a loss of enjoyment of life and caused him to be unable to perform his job-related duties, according to the suit.

Pauley is seeking compensatory damages. He is being represented by Shannon M. Bland.

The case has been assigned to Circuit Judge Carrie Webster.
