CHARLESTON -- A Jackson County couple is suing Charleston Auto Inc. after they claim one of its employees caused a car accident and injuries.
Robert W. Halley, an employee of Charleston Auto, was also named as a defendant in the suit.
On Nov. 14, 2010, Robert Bostic was operating his 2009 Chevrolet K3500 Silverado Pickup truck on Martins Branch Road in Kanawha County and had legally and properly slowed or stopped in the roadway to avoid striking a dog that was in front of his vehicle when Halley, while operating a 2007 Ford Coff Pickup truck owned by Charleston Auto, rear-ended Bostic and caused him injuries, according to a complaint filed July 16 in Kanawha Circuit Court.
Bostic claims Halley failed to notice his brake lights or his slowing or stopped vehicle and struck his vehicle.
Halley was negligent in failing to maintain a safe following distance and failing to maintain a proper look out, according to the suit.
Bostic claims Halley was also negligent in failing to maintain a safe and reasonable speed and failing to yield to his properly slowed or stopped vehicle.
As a result of the defendants' negligence, Bostic incurred medical expenses and sustained inconvenience, annoyance, loss of enjoyment of life, pain and suffering, lost wages and permanent physical injuries, according to the suit.
Bostic and his wife, Paula D. Bostic, are seeking compensatory damages. They are being represented by W. Brent Hackney.
The case has been assigned to Circuit Judge Carrie Webster.
