Cabell couple sues Atomic Distributing for car accident

HUNTINGTON – A Cabell County couple is suing Atomic Distributing Co. after they claim one of its employees caused them injuries.

The employee, Gregory B. Willis, was also named as a defendant in the suit.

On Sept. 25, 2007, Jennifer P. Turley was driving a vehicle in which Eric Turley was a passenger, according to a complaint filed Aug. 8 in Cabell Circuit Court.

The Turleys claim Willis, who was driving a vehicle owned by Atomic Distributing, failed to drive at a safe and reasonable speed and rear-ended their vehicle, causing them injuries.

Willis failed to keep a proper lookout; keep his vehicle under control; drive a safe and reasonable speed, considering the conditions then and there existing; and slow his vehicle to a stop at a reasonable distance behind the Turley vehicle, according to the suit.

The Turleys claim as a result of the defendants' negligence, they suffered physical injuries and non-physical damages, including physical and mental pain and suffering; loss of enjoyment of life; lost wages; and permanent physical impairment and an increased risk of arthritis and other diseases and physical ailments.

As a result of the defendants' negligence, the vehicle owned by the Turleys was destroyed as well as other personal property, according to the suit.

The Turleys are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Scott G. Stapleton.

The case has been assigned to Circuit Judge David M. Pancake.
