CHARLESTON -- A student is suing Everest Institute-Cross Lanes after she was injured while participating in a required school activity.
Corinthian Schools, Inc. was also named as a defendant in the suit.
On Aug. 23, 2010, Meredith McNabb was enrolled as a student studying medical assisting at the defendants' Cross Lanes location and was required to act the role of a patient and be on an examining table several feet above the ground, according to a complaint filed Aug. 10 in Kanawha Circuit Court.
McNabb claims following lying upon the examining table, she was to exit it by placing her feet upon the step which pulled out front the front of the table, which had a small lip on the top portion.
While exiting the table, McNabb was not assisted by any other student, nor by any instructor, according to the suit, and when she placed both feet on the step and attempted to take a second step forward to the ground, she tripped on the lip or other portion of the step, causing her to fall to the floor.
McNabb claims the students and instructor were negligent in failing to assist her from the examining table.
The negligent breach of duty of reasonable and appropriate care and directly and proximately caused McNabb to suffer excruciating pain, permanent injury, loss of enjoyment of life, lost wages and incurring medical bills, according to the suit.
McNabb is seeking compensatory damages. She is being represented by Henry E. Wood III.
The case has been assigned to Circuit Judge Louis H. Bloom.
