Woman sues Rumpke for car accident

HUNTINGTON -- A woman is suing Rumpke Transportation Company, LLC after she claims one of its employees caused a car accident.

Gene Smith, an employee of Rumpke, was also named as a defendant in the suit.

On Sept. 15, 2010, Heather Cremeans was operating a 1999 Chevrolet Blazer westbound and was stopped at a traffic light near the intersection of West 18th Street and Madison Avenue in Huntington, when Smith rear-ended her vehicle, according to a complaint filed Aug. 15 in Cabell Circuit Court.

Cremeans claims Smith was operating a 2004 Auto Truck owned by Rumpke when he violently collided into the rear of her vehicle and caused her injuries.

Smith was cited for failure to maintain control of his vehicle by a Huntington Police officer, according to the suit.

Cremeans claims as a result of Smith's negligent and reckless conduct, she received injuries to her body and mind; sustained physical and mental pain and suffering; suffered from a diminished capacity to enjoy life; possible loss of consortium, earning capacity, household services, annoyance, inconvenience, humiliation and embarrassment; and incurred expenses for medical treatment and hospital care.

The injuries Cremeans sustained were permanent and continuing in nature, according to the suit.

Cremeans is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Kenneth P. Hicks.

The case has been assigned to Circuit Judge David M. Pancake.
