Man says Warner Chilcott violated wage payment act

HUNTINGTON -- A man is suing Warner Chilcott Sales (US), LLC after he claims it violated the West Virginia Wage Payment and Collection Act.

Gary Sims was employed by the defendant, according to a complaint filed Sept. 5 in Cabell Circuit Court.

Sims claims he was only paid his wages once per month.

The defendant violated the West Virginia Wage Payment and Collection Act by only paying employees once per month.

Sims claims the defendant also violated the West Virginia Wage Payment and Collection Act by failing to pay his final wages within 72 hours of discharge.

Sims is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by R.R. Fredeking II.

The case has been assigned to Circuit Judge David M. Pancake.
