Ohio man sues Viking Well Service over final wages

CHARLESTON – A Bridgeport, Ohio, man is suing Viking Well Service, Inc., for allegedly failing to pay his final wages in a timely manner.

Thomas Carter worked for Viking in 2012 until his employment was terminated on Oct. 6, according to a complaint filed Oct. 29 in Kanawha Circuit Court.

Carter claims he did not receive his final wages within 72 hours of termination of his employment.

Viking did not pay Carter his final wages until Oct. 18, according to the suit, and the final paycheck did not contain all the wages Carter was owed.

Carter claims he is entitled to all of his final wages, as well as damages set forth in West Virginia Code.

The defendant’s alleged actions violated the West Virginia Wage Payment and Collection Act and caused Carter damages, according to the suit.

Carter is seeking compensatory damages. He is being represented by Frank X. Duff and Sandra K. Law.

The case has been assigned to Circuit Judge Jennifer Bailey.
