CHARLESTON -- A former employee is suing Motion Industries for alleged age discrimination.
Marshall McClung, an employee of Motion Industries, was also named as a defendant in the suit.
Donald G. Maynor II was employed by Motion Industries, Inc., from Aug. 11, 1997, until Dec. 12, 2011, according to a complaint filed Oct. 23 in Kanawha Circuit Court.
Maynor claims the defendants terminated his employment because of his age.
The defendants’ alleged actions violated the West Virginia Human Rights Act, according to the suit, and caused Maynor to suffer discrimination and damages.
Maynor claims the defendants’ actions were willful and intentional.
McClung committed the act of informing Maynor that he was going to be terminated, according to the suit, and in doing so, violated West Virginia code.
Maynor is seeking compensatory and punitive damages. He is being represented by J. Michael Ranson, Cynthia M. Ranson, George B. Morrone III and G. Patrick Jacobs.
The case has been assigned to Circuit Judge Jennifer Bailey.
