Couple blames GM for allegedly defective vehicle

WAYNE - A couple is suing General Motors, LLC, after they purchased a vehicle they claim was defective.

On Aug. 29, 2009, Brandon and Christina Williams purchased a 2009 GMC Sierra in the amount of $37,172.40, according to a complaint filed Nov. 21 in Wayne Circuit Court.

The Williamses claim since the time of the purchase they have experienced multiple problems, including excessive oil consumption and engine failure.

On at least 10 occasions, the Williamses returned the vehicle to Moses Auto Mall, an agent of General Motors, to have the problems repaired, but the defendant failed to repair the problems within a reasonable period of time, according to the suit.

The Williamses claim General Motors knew or should have known the GMC Sierra was defective prior to their purchase and failed to advise them of the defects.

General Motors had an express and implied warranty to the Williamses under West Virginia code to sell a vehicle free from defects and owes the Williamses damages for aggravation and loss of use of the vehicle, according to the suit.

The Williamses are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Susan J. Van Zant.

The case has been assigned to Circuit Judge Darrell M. Pratt.
