Woman blames K-Mart for injuries

CHARLESTON – A Kanawha County woman is suing K-Mart Corporation for injuries she says she sustained when a display fell over on her.

On June 15, 2011, Yvonne R. Moore was shopping at the defendant’s Charleston store and was standing in front of a display for several minutes, conversing with a friend, when the display suddenly fell over on top of her and caused her injuries, according to a complaint filed Nov. 30 in Kanawha Circuit Court.

Moore claims she had to receive medical treatment for abrasions, contusions and injuries to her left side and chest.

As a result of the defendant’s negligent failure to maintain safe premises, fixtures and display equipment, Moore suffered serious medical injuries, according to the suit.

Moore claims the defendant’s negligence also caused her to suffer annoyance and inconvenience.

K-Mart failed to maintain the display and failed to maintain safe premises at its Charleston store, according to the suit.

Moore is seeking compensatory damages. She is being represented by Richelle K. Garlow.

The case has been assigned to Circuit Judge Charles E. King.
