WINFIELD – A Putnam County man is suing Vossloh Track Material, Inc., after he claims it failed to pay his final wages in a timely manner.
Gary D. Davis was employed by the defendant as a forklift operator until his discharge on Sept. 4, according to a complaint filed Jan. 8 in Putnam Circuit Court.
Davis claims the defendant had a duty to pay his final wages within 72 hours of his discharge and failed to do so.
Vossloh did not give Davis his final wages until Sept. 13, according to the suit.
Davis claims the defendant’s actions were in violation of the West Virginia Wage Payment and Collection Act.
The defendant’s action entitles Davis to treble damages, according to the suit.
Davis is seeking compensatory and treble damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge Joseph Reeder.
