Technicrete says Tri-State Hotels failed to pay for goods, services

CHARLESTON – Technicrete Corporation is suing Tr-State Hotels, LLC, after it claims it failed to pay for goods and services.

Jai Sai, LLC; Stephen L. Thompson, trustree of the National Republic Bank of Chicago; the National Republic Bank of Chicago; and Dolatrai Patel, also known as Junior Patel, were also named as defendants in the suit.

In April, Technicrete, and its owner Thomas M. Bomkamp, entered into a contract with Tri-State and Patel for certain concrete pours to be completed at a proposed Holiday Inn Express located in Cross Lanes, according to a complaint filed Jan. 11 in Kanawha Circuit Court.

Technicrete claims it completed with the contract and timely completed work, however, the defendants failed and refused to pay for the work it completed.

The defendants breached their contract with the plaintiffs by failing to pay for the goods and services Technicrete provided, according to the suit.

The plaintiffs are seeking that Technicrete’s mechanic’s lien be adjudged a valid lien against Jai Sai and compensatory damages in the amount of $34,977 with contractual interest and pre- and post-judgment interest. They are being represented by Stephen J. Golder, Garry A. Matthews and J. Tanner James.

The case has been assigned to Circuit Judge Carrie Webster.
