CHARLESTON – A Spencer woman is suing Dick’s Sporting Goods, Inc., after she claims she was injured when she slipped on a wet floor.

On April 21, 2011, Traci Frederick was shopping in the defendant’s South Charleston store when she slipped and broke her wrist, according to a complaint filed Jan. 7 in Kanawha Circuit Court.

Frederick claims the floor had been cleaned and waxed, but no sign was there to indicate that the floor was slippery.

The defendant knew or should have known that its floor was slippery and hazardous to patrons, according to the suit.

Frederick claims despite what the defendant knew or should have known about the condition of its floor, it made no effort to prevent patrons from walking on the portion of the floor where she slipped.

The defendant was negligent in using flooring materials that were unreasonably slippery; oiling, waxing or otherwise treating the floors in its store in a way that made them unreasonably slippery; failing to properly inspect the floor in its store to make sure it was reasonably safe to walk on; failing to rope off or otherwise close the area of the store that was unsafe; and failing to warn customers that the area was not safe to walk on, according to the suit.

Frederick is seeking compensatory damages with pre- and post-judgment interest. She is being represented by James A. McKowen.

The case has been assigned to Circuit Judge Charles E. King.
